Terms & Conditions

Definitions
“You” means the person whose order for the Goods is accepted by Roger la Borde.

“Goods” means the Goods which Roger la Borde will supply in accordance with your order.

“Roger la Borde”, “Us”, “We” means Nicholls Shipping, trading as Roger la Borde, a partnership trading
from 87 Kingsgate Road, London NW6 4JY.

“Terms” means these standard Terms and Conditions of Sale set out in this document and includes any special terms agreed in writing between us.

“Contract” means the Contract for the purchase and sale of the Goods.


The sale
These Terms shall govern the sale and supply of Goods by Roger la Borde to you. All other terms and conditions of trading are excluded. If you wish to rely on any variation in these terms you should ensure that such variations are recorded in writing.

Any error or omission in any information or document issued by Roger la Borde shall be subject to correction provided that the correction does not materially affect the Contract.


Orders
All major credit cards and debit cards are accepted as methods of payment by Roger la Borde. These are processed by Shopify or Paypal on their secure server. We do not handle or store your card information.

The display of goods on rogerlabore.com is not an offer to sell. No offer submitted by you for the purchase of Goods shall be accepted until Roger la Borde has confirmed receipt of and acceptance of the offer and receipt of payment by e-mail. Acceptance is deemed effective upon Roger la Borde sending the e-mail and confirmation and is subject to stock availability.

We will inform you by e-mail if any items you order turn out to be unavailable.


Pricing
The price of the goods is in pounds sterling and is inclusive of VAT.

All charges must be paid in full prior to delivery. Legal ownership in the Goods remains with Roger la Borde until payment is made.


Delivery
Deliveries to addresses that are different from the billing address are subject to vettingto confirm their validity. 

We aim to dispatch goods within 48 hours of an order being placed and will keep you informed by email of any delays.  

If you need to an order urgently, we can often accommodate but there maybe an extra charge for courier or rushed service. Please get in touch at orders@rogerlaborde.com to arrange.

Shipping to UK mainland:
We use standard mail services like Royal Mail first class or DHL Parcel unless arranged directly with us.  Packages typically take 3-5 working days from shipping to be delivered.

Shipping overseas
We ship overseas using Royal Mail Standard for packages weighing 750g and below and tracked for packages weighing between 750g and 2kg. Current prices can be seen at checkout before you complete your order. Overseas packages typically take 5-7 working days to be delivered.  If you do not see a shipping price at checkout it means your package is over 2kg or we don't have a shipping method for your country. Please contact us at orders@rogerlaborde.com and we will obtain a shipping quote for your order.

Please be aware you have to pay customs and import duty charges on overseas orders. These charges will be specific to your country and we cannot advise on what they might be. Roger la Borde is not liable for these charges.

Using the Roger la Borde Shop Website
rogerlaborde.com is set-up and maintained with the intention to provide you with as efficient and user-friendly service as possible. However, we cannot guarantee that the site will be error free.

We also cannot guarantee that the goods you receive will be identical to those shown in the pictures. Colours vary significantly between computer displays and we cannot be responsible for colour differentials between what you see on your device and the product you receive.

We reserve the right to alter/make changes to all aspects of the website including the look and feel, the products displayed, information about products and product prices at any time.


Copyright
The legal ownership and any copyright or other intellectual property rights in the site and its design, text, graphics, and all other material on the site shall belong to Roger la Borde at all times, unless otherwise stated.

Intellectual property in the products sold and their designs resides with the individual suppliers, and licence holders


Trademarks
All trade marks, logos, and service marks displayed on the site including Roger la Borde, are either registered or unregistered trade marks of Roger la Borde. No rights are guaranteed to use any of them without prior written permission of Roger la Borde.

Roger la Borde will enforce its intellectual property rights, without hesitation, to the fullest extent of the law.


Exclusions
Subject to your statutory rights we shall not be liable to you for any loss or damage (whether for loss of profit or otherwise) arising from your use of the site or its material or content.

Roger la Borde shall only be liable for losses that are foreseeable and will not be liable to you or deemed to be in breach of the Contract by reason of any delay in performing or any failure to perform any of our obligations in relation to the Goods lack of access to the site or the site being unavailable if the delay or failure was due to Act of God, your act of default or any cause beyond our reasonable control.


Jurisdiction
These terms will be governed by English law and in the case of dispute will be submitted in the non-exclusive jurisdiction of the English Courts. If access to the site is from outside the UK you are responsible to ensure compliance with any local laws if and to the extent such laws are applicable.


Severance
If any provision of these terms is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these terms and the remainder of the provision in question shall not be affected.


Third Party
For the avoidance of doubt nothing in these terms shall confer on any third party any benefit or the right to enforce any term.


Waiver
No waiver by Roger la Borde of any breach of the contract by you shall be considered as a waiver of any subsequent breach of the same or any other provision.
